    Terms of Services Patients

    Effective Date: February 19, 2026

    These Terms of Service ("Terms") constitute a binding legal agreement between Telehealth NP, a Colorado entity doing business as Telehealth Professional ("Company," "we," "our," or "us"), and any individual who accesses or uses our website, telehealth platform, mobile application(s), clinical services, asynchronous messaging tools, subscription services, or related offerings ("you" or "User"). By creating an account, using our services, or accessing telehealthprofessional.com, you agree to be bound by these Terms, our Privacy Policy, HIPAA Notice of Privacy Practices (NPP), and Telehealth Informed Consent. If you do not agree with any portion of these Terms, you must not use our Services.

    1. DESCRIPTION OF SERVICES

     

    Telehealth Professional provides telemedicine and related virtual services, including:

    • Virtual urgent care

    • Primary care

    • Behavioral health and therapy services

    • Psychiatric services (excluding controlled substances)

    • Comprehensive prescription management (with limitations described herein)

    • Specialty care for adults, geriatrics, family health, women’s health, pediatrics, and psychiatric care

    • Telehealth asynchronous messaging (store-and-forward communication)

    • AI-assisted symptom checker and chatbot tools

    • Functional and integrative medicine

    • Chaplain and spiritual support services

    • One-time visits, membership models, and subscription plans

     

    You understand and agree that the Services may include communication with licensed clinicians (“Clinicians”), clinical recommendations, secure messaging, non-clinical administrative support, and technology tools that facilitate access to care.

    2. NO EMERGENCY SERVICES

    OUR SERVICES ARE NOT FOR MEDICAL EMERGENCIES.

    If you are experiencing a medical or psychiatric emergency, call 911 or go to the nearest emergency department immediately. We do not provide crisis intervention, emergency behavioral health services, or real-time monitoring.

    3. AGE AND ELIGIBILITY REQUIREMENTS

    You must be:

    • At least 18 years old to independently create an account and use our Services; or

    • At least 13 years old with verifiable parental or legal guardian consent

    Parents/guardians agree to be fully responsible for a minor’s use of the Services.

    4. PROVIDER–PATIENT RELATIONSHIP

    A provider–patient relationship is established only after:

    1. Your account is created,

    2. You complete any required intake documentation, and

    3. A licensed Clinician reviews your information and agrees to treat you.

    Using the website, AI tools, educational content, or symptom checker does not create a provider–patient relationship.

    5. AVAILABILITY AND GEOGRAPHIC LIMITATIONS

    Telehealth Professional is incorporated in Colorado but operates in all 50 states.

    Clinical care is provided only by licensed Clinicians practicing within their scope and state licensure.

    Availability may vary by state based on regulatory requirements.

    6. PRESCRIBING POLICIES

    Our Clinicians do not prescribe:

    • Controlled substances (Schedule II–V medications)

    • Abortifacients

    • Medications used for gender conversion or hormonal gender-affirming therapy

    Any prescription is subject to medical appropriateness, state laws, clinical judgment, and professional standards.

    We reserve the right to refuse any prescription request.

    7. TECHNOLOGY FEATURES & AI TOOLS

    Our platform may use AI-assisted tools including symptom checkers, educational suggestions, and automated messaging.

    AI tools:

    • Do not provide medical advice

    • Do not diagnose or prescribe

    • Do not replace Clinicians

    All medical decisions are made by licensed human Clinicians.

    8. USER RESPONSIBILITIES

    You agree to:

    • Provide accurate, complete, and updated information

    • Only use the Services for lawful purposes

    • Not misuse or falsify medical information

    • Not impersonate anyone else

    • Not use the Services for emergencies

    • Comply with all federal and state laws

    You are responsible for your account security and must notify us immediately if unauthorized access is suspected.

    9. ACCEPTABLE USE POLICY

    You may not:

    • Attempt to disrupt, damage, or interfere with the Services

    • Reverse engineer, scrape, or data-mine the platform

    • Harass or abuse Clinicians or staff

    • Upload harmful, threatening, or malicious content

    • Use automated tools to access or interact with the Services

    Violations may result in account suspension or termination.

    10. TELEHEALTH INFORMED CONSENT

    By using our telemedicine platform, you acknowledge:

    • Telehealth may involve electronic transmission of medical information

    • Technical failures may occur

    • Clinicians rely on information you provide

    • You may not receive the same evaluation as an in-person visit

    • Alternatives to telehealth may exist

    • You may withdraw consent at any time

    11. HIPAA NOTICE OF PRIVACY PRACTICES

    We protect your health information in accordance with HIPAA.

    Our HIPAA Notice of Privacy Practices (NPP) explains:

    • How your PHI is used and disclosed

    • Your HIPAA rights

    • Our responsibilities under federal law

    By using our Services, you acknowledge receipt of our NPP.

    12. PAYMENT, FEES, & BILLING

    Telehealth Professional currently operates on:

    • Cash-pay only

    • No insurance billing

    • Subscription and membership plans

    • One-time visit fees

    By purchasing any service, you agree to pay all applicable fees at the time of service or at subscription renewal.

    Prices are subject to change with notice.

    13. REFUND POLICY

    Refunds are available only under the following circumstances:

    • Technical failure preventing the visit

    • Clinician determines care cannot be provided after intake

    • Duplicate charges due to system error

    Refunds are not issued for:

    • Dissatisfaction with clinical decisions

    • Failure to follow instructions or complete required forms

    • Missed appointments

    • Completed services or digital products

    Subscription refund terms are governed by Section 14.

    14. SUBSCRIPTION & MEMBERSHIP CANCELLATION

    Subscriptions automatically renew unless canceled.

    You may cancel at any time; however:

    • Cancellations are effective at the end of the current billing cycle

    • No prorated refunds are issued

    • Access to subscription services continues until the end of the paid period

    We may terminate subscriptions for misuse, non-payment, or regulatory reasons.

    15. NO WARRANTY – SERVICES PROVIDED “AS IS”

    To the maximum extent permitted by law:

    • We provide no warranties of any kind, express or implied

    • We do not guarantee uninterrupted or error-free service

    • We disclaim any warranties of merchantability, fitness for a particular purpose, or non-infringement

    16. LIMITATION OF LIABILITY

    To the fullest extent permitted by law:

    • Telehealth Professional, its owners, Clinicians, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages

    • Liability is limited to the amount you paid for the applicable service within the previous 12 months

    Some states may not allow certain limitations; in such states, limitations apply to the fullest extent permitted.

    17. DISPUTE RESOLUTION & ARBITRATION

    Except where prohibited by law, any dispute arising from these Terms or your use of the Services shall be resolved by binding arbitration:

    • Conducted by the American Arbitration Association (AAA)

    • Located in Colorado

    • Governed by the Federal Arbitration Act

    • No class actions or collective claims allowed

    You may opt out of arbitration within 30 days of first using the Services by submitting written notice to us.

    18. TERMINATION

    We may suspend or terminate your account:

    • For violations of these Terms

    • If required by law

    • For abusive behavior toward staff or Clinicians

    • For fraud or misuse

    You may stop using the Services at any time.

    19. INTELLECTUAL PROPERTY

    All platform content, software, logos, trademarks, and materials are the property of Telehealth Professional. You may not reproduce, distribute, modify, or create derivative works without written permission.

    20. GOVERNING LAW

    These Terms are governed by the laws of the State of Colorado, without regard to conflicts of law principles.

    21. CHANGES TO TERMS

    We may update these Terms at any time.

    When updated, the “Effective Date” will change.

    Continued use of the Services constitutes acceptance of updated Terms.
